Unified Agenda of Federal Regulations The federal government must publish the status of agencies’ regulatory actions twice yearly and the White House Office of Management and Budget (OMB) recently released the Spring 2023 Unified Agenda of Regulatory Actions. Here are additional DOL/OSHA details:
NLRB Actions On June 13, the National Labor Relations Board issued its decision inThe Atlanta Opera case overturning the Trump-era SuperShuttle decision reinstating the Obama-era FedEx Home Delivery standard for whether a worker is an independent contractor under the National Labor Relations Act. Per the Coalition for a Democratic Workplace led by Associated Builders & Contractors, “The decision…ignores the DC Circuit’s rebuke of FedEx Home Delivery, in which the court criticized the Board for its attempt to implement a narrow independent contractor standard beyond what was permissible by the common law.” Also, on May 30, the NLRB’s General Counsel issued a memo finding that many employer-mandated non-compete agreements infringe on employees’ rights under the National Labor Relations Act. West Coast Labor Negotiations On June 14, the International Longshore and Warehouse Union (ILWU) and Pacific Maritime Association announced a tentative agreement on a new six-year contract. The ILWU represents over 22,000 workers at 29 West Coast ports and this new collective bargaining agreement must be ratified over the next 6-8 weeks. TPS Extended for Migrants from Certain Countries The Biden Administration has extended temporary protected status (TPS) for over 330,000 immigrants. This allows migrants from El Salvador, Honduras and Nicaragua to renew work permits for 18 months. Today, we are highlighting the story of one of our TRI Alliance members, Ami Feller, owner and CEO of Roofer Chicks.
Although she never imagined that she would one day own a roofing company, she has found great success building and leading her all-female crew in New Braunfels, Texas. Her career in roofing began as she worked for her brother’s roofing crew back in the 90’s, initially by picking up construction debris, then eventually getting promoted to the roof crew, then crew lead, and finally to operations manager. Together, she and her brother started various construction entrepreneurial enterprises over the years. Ultimately, they found they had different management philosophies and in 2016, Ami broke away and started her own company, Feller Roofing. In 2020, Ami began putting together an all-female crew, and in 2021, rebranded to Roofer Chicks. Roofer Chicks is a residential and commercial roofing contractor, with a heavy concentration on residential reroofs and repairs. They install and service all types of roofing – asphalt shingles, metal, clay and concrete tiles, TPO, modified bitumen, and coatings. In 2022, the company opened a Handyman Division to diversify its product offerings, and in 2023 the company became a Window Depot affiliate, offering windows and doors as part of its product offerings. When asked why she joined TRIA, she explained that she decided to join in 2020 because, while her company offered tile repairs through subcontractor labor, Ami did not feel like she, herself, knew much about tile installation. She really enjoyed the class very much and felt much more equipped as a business owner to pursue tile work in her market. In fact, she was so impressed with the class, she has since asked key personnel to also get certified.
