The One Big Beautiful Bill (OBBB) On May 22, the House passed the One Big Beautiful Bill Act, H.R. 1, on a 215-214 party-line vote and Senate Republicans are now drafting their bill using H.R. 1 as the basis. On June 16th, the Senate Finance Committee released its part of the bill with tweaks to the tax title. For example, the 549-page Finance title terminates the Energy Efficient Commercial Tax Deduction (179D) whereas the House bill doesn’t touch it. But like the House bill, the Energy Efficient Home Improvement Credit (25C), Residential Clean Energy Credit (25D for solar), and New Energy Efficient Home Credit are all terminated though on slightly different timetables. Project Labor Agreements (PLAs) In a surprising move, the White House Office of Management and Budget (OMB) issued a memo keeping a Biden-era mandate that federal agencies use union Project Labor Agreements (PLAs) on large federally funded construction projects. The memo adds a caveat that PLAs should be used when they are “practicable and cost effective” but Associated General Contractors and Associated Builders and Contractors are disappointed and will likely continue their legal challenges to PLAs. OSHA Developments At a June 5 Senate Health, Education, Labor, and Pensions Committee hearing, President Trump’s nominee for OSHA, David Keeling, told lawmakers the agency would issue a regulation to address workplace violence. While OSHA waits for Keeling’s Senate confirmation, its proposed heat rule continues to move forward with agency hearings on the rule taking place June 16 – July 2, from 9:30 am – 4:30 pm on weekdays, and moderated by an Administrative Law Judge. There will be a 90-day post-hearing comment/legal brief period until Sept. 30. Immigration Enforcement On June 13, the Trump Administration directed Immigration and Customs Enforcement (ICE) to pause worksite raids on agriculture and meat-packing plants, restaurants, and hotels. However, this pause comes after the White House set a May 29 goal backed by Dept. of Homeland Security Secretary Kristi Noam of ICE making 3,000 illegal immigrant arrests daily, which suggests construction and other industries might see heightened ICE enforcement.
